TrulySpeak Terms of Use
Last updated 13 August 2026. These Terms govern the website, marketplace, accounts, Tutor profiles, booking, communications, payments, wallet and related services.

2. What TrulySpeak provides
TrulySpeak is an online language-learning marketplace and workspace. It helps adult Students discover Tutors, review profiles and availability, request lessons, communicate, and manage lessons and payments. Tutors maintain profiles and availability, manage requests, teach, communicate, and use the available financial and operational tools.
The precise contractual supplier and merchant-of-record role for each paid lesson is Not configured — required before deployment. Nothing in these Terms changes mandatory consumer rights.
3. Accounts and eligibility
The initial release is for adults aged 18 or older. Registration requires an explicit adult declaration and acceptance of the current Terms. Keep account information accurate and credentials secure. Do not impersonate others, transfer accounts without authorization, or bypass role, payment, security, moderation or access controls.
4. Student responsibilities
- Provide accurate booking and account information.
- Attend lessons on time and use the Platform respectfully.
- Use booking, cancellation, rescheduling and reporting tools in good faith.
- Pay amounts properly due under the booking and payment flow.
- Respect Tutors’ intellectual-property, privacy and personal rights.
- Do not record or redistribute lessons, videos, messages or private content without a lawful basis and any required permission.
5. Tutor responsibilities
- Keep profile, language, teaching, availability and pricing information accurate.
- Promptly manage lesson requests and provide lessons professionally and lawfully.
- Use profile media only when they hold the necessary rights and permissions.
- Meet the tax, registration, invoicing and professional duties applicable to their activity.
- Protect Student information and do not manipulate transactions, reviews, rankings or safety systems.
Trader or business status is not inferred. TrulySpeak may request and display legally required identity or business information when an applicable relationship and verified process require it.
6. Tutor profiles, ranking and marketplace presentation
Public profiles use approved profile fields, languages, specialties, price, availability, reviews and introduction media. The server returns eligible published Tutors in stable display-name order. The interface supports price, rating and availability sorting or filtering. Audited, time-limited Staff promotion or suppression can affect inclusion. No paid ranking placement is implemented.
7. Tutor applications and introduction videos
Applications may collect supported identity, profile, experience, language and availability information. The application video is a public Tutor introduction shown to Students after approval and moderation, not a CV video. Submission guarantees neither approval, publication, Students, lesson volume nor earnings.
8. Lessons, requests and Session status
A request is not confirmed until the server-authoritative booking state says so. Availability can change because of holds, bookings, cancellations, Special periods, conflicts or Tutor changes. Users should rely on the current status displayed by TrulySpeak.
9. Prices, wallet, payments and Tutor earnings
Money records are immutable, balanced and currency-scoped. Stripe is the mandatory initial Student payment provider. Confirming a booking holds its quoted value from the Student balance, which cannot become negative. The default Platform commission is 25%, but an effective-dated global or Tutor-specific policy is captured in each immutable booking snapshot.
Eligible Tutor earnings are evaluated at month end. Amounts below the USD 20 equivalent in the configured payout currency roll over. Local payout execution uses controlled PayPal evidence and does not itself call a live provider. Lawful refunds, disputes, chargebacks and corrections may alter earnings through compensating entries.
10. Cancellation, rescheduling, withdrawal and refunds
The Refund, Cancellation and Withdrawal Policy forms part of these Terms and does not reduce non-waivable rights.
11. Messages, lesson information and privacy
Private communications and lesson information are processed to deliver the service, retain Session history, support users, investigate incidents and enforce safety and contractual rules. Staff access is capability limited. See the Privacy Policy.
12. Reviews and user content
Users retain their underlying content rights and grant TrulySpeak a non-exclusive, worldwide, royalty-free licence to host, format, display and transmit submitted content only as reasonably needed to operate, secure, moderate and provide the relevant feature. Public approved Tutor profiles and introduction media may be displayed in the marketplace.
13. Intellectual property
The TrulySpeak name, logo, interface, software and original site content belong to TrulySpeak or its licensors, excluding user-owned and third-party material. Use is limited, revocable and non-transferable. Unlawful copying, scraping, interference, reverse engineering or resale is prohibited except where law expressly permits it.
14. Acceptable use and safety
Do not harass or discriminate, use the Platform unlawfully, gain unauthorized access, introduce malware, scrape personal data, or manipulate ratings, availability, Sessions, payments, identity, reporting, refunds or moderation. TrulySpeak may investigate and restrict activity where reasonably needed for safety, law, security or enforcement.
15. Suspension and termination
Supported privacy tools permit account closure subject to lawful retention and unresolved obligations. Material or repeated breach, fraud, safety or security risk, unlawful conduct, and required legal action may lead to restriction, suspension or termination. Tutor decisions use audited incidents and appeal workflows where applicable; final business-user notice and appeal wording requires legal review before deployment.
16. Third-party services
Configured services can include infrastructure and storage, Stripe, PayPal, Google or Microsoft sign-in, Cloudflare Turnstile, email, Google Calendar/Meet, and privacy-enhanced YouTube media. Each may have its own terms. Local adapters and fixtures do not imply live-provider activation.
17. Availability and changes
Uninterrupted operation is not guaranteed. Features and security controls may change; material contractual changes will be communicated as required by applicable law.
18. Liability
Nothing excludes liability or mandatory protections where exclusion is prohibited. Any additional limitation requires review against the final contracting model and the relevant consumer or business-user status.
19. Complaints, reporting and disputes
Users may use the in-product Session, incident, support and privacy tools. The external legal/support contact is Not configured — required before deployment. Competent consumer-protection and alternative-dispute mechanisms remain available under applicable law. No discontinued EU ODR link is used.
20. Governing law
Spanish law applies to the extent permitted. Consumers retain mandatory protections and jurisdiction determined by applicable consumer and procedural law.
